Agency Services
Insofar as Tourismusverband Sieben e.V., or intermediary online booking platforms such as Booking or BestFewo, or local and regional tourism and booking offices arrange accommodations, package deals, or other services, the statutory provisions applicable to travel agents shall apply to the legal relationship with the guest within the scope of the agency agreement.
As agents, the above-mentioned entities are responsible for the arrangement itself, but not for the arranged service. The legal relationship between the guest and the accommodation provider is governed by the applicable statutory provisions and, where effectively agreed, by the general terms and conditions of the respective provider.
Package Deals
For package deals, the responsible tour operator, who becomes your contractual partner in the event of a booking, is specified in the respective offer or in the booking confirmation.
The relevant statutory provisions apply to the legal and contractual relationship between the guest and the provider of the package (tour operator) (for package deals in particular Sections 651 a - m of the German Civil Code (BGB) and Sections 4 - 11 of the Ordinance on Information Obligations under Civil Law and, where effectively agreed, the general terms and conditions of the provider).
Please note the following special provision: Providers of package deals are exempt from the statutory obligation to provide so-called customer money protection (and the resulting obligation to issue a security certificate) if the guest’s contractual partner is a tourism office that is a direct public institution (e.g., a spa, transport, or tourism office) of a city, municipality, or other local public authority. Of course, even with such providers, your deposit or advance payment for package deals remains secure.
